Legal Complaints
The Society's humane officers perform a range of services from investigating animal abuse and neglect to conducting rescues and providing public safety services. In addition, they enforce Hawaii's animal cruelty laws and educate the public about responsible pet ownership.
 
With a dedicated team on duty every day, these officers respond to more than 10,000 calls for service every year. Their goal is ensure the safety and well being of animals as well as protecting the community from dangerous and nuisance animals.
 
Cruelty
If you suspect an animal is being abused, please contact us immediately at 877-3680. A humane officer will respond to check on the animal and take appropriate action to ensure the animal's well being. If you witness an animal being abused during those hours when our shelter is closed, contact the Maui Police Department at 244-6400 or 911. Those convicted of animal cruelty face a maximum penalty of $2,000 and/or one year in jail.
 
Neglect
If you suspect an animal is being deprived of adequate food, water, shelter or medical attention, please contact us at 877-3680. A humane officer will respond to check on the animal's condition and take appropriate measures to ensure the animal's well being. In many cases, educating the pet owner about proper care of the animal will help alleviate the problem. An officer will follow up to make sure the animal is being properly cared for, and if not, may charge the owner with animal neglect or cruelty to include possible removal of the animal. Those convicted of animal neglect face a maximum penalty of $500. Those convicted of animal cruelty face a maximum penalty of $2,000 and/or one year in jail.
 
Rescue
Humane officers are on-call 24 hours a day to rescue an animal in distress. Contact us at 877-3680 with information about the animal's location and condition. For those hours when we are closed, call the Maui Police Department at 244-6400 or 911. An on-call humane officer will be immediately contacted to respond.
 
Dog Bites
If you have been bitten by a dog, know someone who has, or your own animal has been seriously attacked by a dog, it is imperative to report it to the humane society as soon as possible. Call us at 877-3680 to report a dog bite or if you have had an encounter with an aggressive dog. For those hours when we are closed and you need immediate assistance, call the Maui Police Department at 244-6400 or 911 for police response. You will still need to contact us during our regular business hours as we are the primary agency that investigates and takes appropriate action regarding dog attacks.
 
Barking Dog Complaints
A dog owner is in violation of Maui County's animal nuisance law when their dog barks constantly for 10 minutes or intermittently for 20 minutes. It is not unlawful for a dog to bark excessively if in response to a person trespassing on the dog owner's property or a person is teasing or provoking the dog. Those convicted of excessive barking face a maximum penalty of $500. Complaints need to be filed with the humane society by contacting us at 877-3680. An informational packet will be sent to the complainant explaining our procedures for responding to barking complaints. Upon receipt of a written complaint, we will respond as follows: First Complaint: a humane officer will deliver a complaint letter, along with educational materials to the dog owner, informing them that a complaint has been received about the dog. Second Complaint: a humane officer will deliver a warning letter to the dog owner advising that their case will be forwarded to the County Prosecutor's office should they fail to control the dog's excessive barking. Third Complaint: The case will be forwarded to the Prosecutor's office to have charges filed for violation of Maui County's animal nuisance law. The humane society encourages attempting resolution by neighbor to neighbor communication or mediation services. Mediation services have been proven to be very effective in resolving neighborhood barking problems.
 
Abandonment
It is illegal to abandon any animal in Hawaii. Abandoned animals suffer from starvation, attack, injury and disease. To report an animal you think may have been abandoned, please contact us at 877-3680.
 
Pet Waste Pickup
Allowing your pet to defecate without disposing of it is not only unsightly, it poses a potential health hazard as feces is a contaminant and can carry disease. Maui County law requires the immediate removal and proper disposal of a dog's waste when the dog defecates on any property other than the dog owners'. Those convicted for a dog waste violation face a maximum penalty of $500.
 
Leash Law
Dogs that are allowed to run loose are at great risk of becoming lost, injured, or killed. A loose dog can be a nuisance or threat to people and other animals. All dogs in Maui County are required to be properly restrained at all times. If located on private property, dogs must be contained by way of a fully enclosed yard, kennel or leash. In addition, dog owners must have the express consent of the property owner for dogs to be allowed on private property. On public property, dogs must be restrained on a leash not more than 10 feet in length. The leash must be held by a responsible person. For dogs traveling in the bed of a truck, the dog must be secured to prevent him from climbing or falling out of the truck bed. To report a leash law violation, please contact us at 877-3680. Those convicted of leash law violation face a maximum penalty of $500.
 
Licensing
A current Maui County dog license is your pet's ticket home should he stray or become lost. All dogs in Maui County over the age of 4 months must be currently licensed. This includes indoor dogs, dogs that are kenneled or fenced, and dogs that "never" leave your property. Dog licenses must be current, clearly visible and worn by your dog at all times. Dog licenses are not transferable from one owner to the next. Dog licenses are inexpensive and available at various locations throughout Maui County. Please contact us at 877-3680 for further information. Owning or harboring an unlicensed dog carries a maximum penalty of $500.
 
Deceased Animal Removal
The Maui Humane Society provides deceased animal removal of stray dogs and cats from public roads and property. Please contact us at 877-3680 for service and assistance.
 
Livestock at Large
Loose livestock can pose a serious threat to motorists, as well as cause extensive damage to crops and landscaping. It is illegal in Maui County to allow livestock to run at large. In addition, livestock are required to be contained by lawful fences in good repair. To report loose livestock, contact the Maui Police Department at 244-6400.
 
Crowing Roosters
Currently, there are no animal specific laws addressing crowing roosters. Rooster noise can be enforced through Hawaii's disorderly conduct statute. To report rooster noise, contact the Maui Police Department at 244-6400. Please note that the Maui Humane Society has no authority to enforce rooster noise.
 
Stray Animal Pickup
Please contact us at 877-3680 if you have found an animal. If you need humane officers to pick up the animal, we ask that the animal be contained. There is no charge to pickup a stray animal.
